These Terms & Conditions apply to products and services supplied by Black Forge Art. Please read them before placing an order. Nothing in these terms affects your statutory rights.

Black Forge Art is a family-run UK metalwork business specialising in handmade and bespoke metalwork.

Orders

Orders may be placed through our website or agreed directly with us by email, telephone or in person.

Please check all product selections, dimensions, wording, designs, delivery details and other information carefully before confirming an order.

Where we provide a quotation, drawing or specification for bespoke work, the customer’s acceptance of that quotation or specification forms part of our agreement.

We reserve the right to decline an order before it has been accepted, including where a product is unavailable, we cannot reasonably fulfil the requirements, payment cannot be verified or an obvious pricing or listing error has occurred.

Handmade and Bespoke Products

Our products are predominantly handmade to order and many are manufactured to individual customer requirements.

Small variations between handmade products and website photographs are normal and form part of the nature of handmade manufacture. Dimensions, weights and specifications may be approximate where stated as such, and colours displayed on screens may differ slightly from the finished product.

For bespoke work, customers are responsible for checking and approving any drawings, artwork, wording, spelling, dimensions or other specifications submitted for approval before manufacture.

Once approved, we will manufacture the product based on that approval. Changes requested afterwards may incur additional costs and affect the lead-time.

Lead-Times

Our products are predominantly handmade to order and therefore require a manufacturing lead-time.

Current estimated lead-times are shown on our website or will be advised when an order or bespoke commission is discussed.

Lead-times are estimates unless we have expressly agreed a specific guaranteed completion or delivery date with you. They may occasionally change because of workload, material availability, supplier delays, specialist processes or circumstances outside our reasonable control.

If an order is required for a birthday, anniversary, Christmas, installation or another specific date, please contact us before ordering. We will confirm whether we believe the required date can be achieved.

Prices and Payment

Prices shown on our website include VAT where applicable unless stated otherwise.

For bespoke commissions, the price and payment schedule will be stated in our quotation or correspondence.

We may require a deposit before commencing bespoke work, with the remaining balance payable at the agreed stage and normally before dispatch or collection.

Website orders are normally payable when the order is placed.

Goods remain the property of Black Forge Art until payment has been received in full.

Pricing and Listing Errors

We take reasonable care to ensure prices, specifications and product information are accurate.

If an obvious pricing, description or technical error is discovered after an order has been placed, we will contact you as soon as reasonably possible. Where appropriate, you will be offered the choice of proceeding on the corrected basis or cancelling the affected order for a full refund.

We will not increase the agreed price of an accepted consumer order simply because our material or manufacturing costs subsequently increase, unless you request a change to the agreed specification or another price adjustment is specifically agreed.

Delivery

Delivery charges and available delivery methods are shown during checkout or agreed as part of a quotation.

Manufacturing lead-time and delivery transit time are separate. Once manufacture is complete, we will normally dispatch the order using an appropriate courier or delivery service.

Courier delivery times are estimates unless expressly stated otherwise. Tracking information will be provided where available.

Customers are responsible for providing an accurate and accessible delivery address and any relevant delivery information.

If delivery fails because nobody is available, an incorrect address has been supplied or the courier’s redelivery or collection instructions are not followed, reasonable additional delivery charges may be payable.

Large, heavy or cumbersome products may require kerbside or vehicle-side delivery and suitable assistance or equipment for unloading. Where applicable, we will endeavour to make this clear before delivery.

We strongly recommend that customers do not book installers, tradespeople or other work dependent upon an order until the goods have arrived and been checked.

International Delivery

We may deliver certain products outside the United Kingdom.

International delivery charges calculated by our website may occasionally require adjustment because of the size, weight, destination or nature of a product.

If an additional delivery charge is necessary, we will contact you before dispatch. You may accept the revised charge or cancel the affected order for a full refund where the additional charge was not agreed when the order was placed.

Unless expressly stated otherwise, the customer is responsible for any import duties, customs charges, local taxes or similar charges imposed by the destination country.

International delivery times are estimates and may be affected by customs and local delivery services.

Returns & Refunds

We want you to be happy with your Black Forge Art purchase and offer a clear 28-day return period for eligible products.

For eligible standard products, a return may be requested within 28 days of the original delivery date, provided the product remains in its original delivered condition and has not been installed, fitted, used, altered or damaged.

We will provide the appropriate return instructions.

Unless the product is faulty, damaged or incorrect, the customer is responsible for the cost of returning the product to Black Forge Art.

Products must be appropriately packaged and protected for the return journey. We recommend using a suitable tracked or insured delivery service for valuable items.

Once an eligible returned product has been received and checked, we will process the applicable refund to the original payment method.

For eligible distance-sale cancellations where statutory cancellation rights apply, refunds will be made within the timescales required by UK consumer law. Where required by law, this will include the original standard delivery charge. Additional amounts paid for an enhanced or premium delivery service are not necessarily refundable beyond the cost of standard delivery.

We may make a lawful deduction from a refund where an eligible returned product has been handled beyond what would reasonably be permitted when examining it in a shop and its value has consequently been reduced.

Bespoke and Personalised Products

Many Black Forge Art products are made specifically to a customer’s requirements.

The normal statutory change-of-mind cancellation right applicable to many online purchases does not apply to goods made to the consumer’s specifications or clearly personalised.

This may include products incorporating bespoke artwork, customer-supplied photographs, names, wording, logos, individually requested designs, bespoke dimensions or other individual specifications.

This does not affect your rights where a bespoke or personalised product is faulty, damaged, not as described or does not conform to the agreed specification.

If you wish to cancel a bespoke order, please contact us as soon as possible. Where design or manufacture has not commenced, we will normally be able to cancel the order and refund payments made.

Where design, manufacture, material purchasing or other work has already begun, we will explain what work and costs have been incurred and what refund, if any, can reasonably be provided.

Faulty, Damaged or Incorrect Goods

If an item arrives damaged, is faulty or is not what you ordered, please contact us as soon as reasonably possible.

Where possible, please provide photographs of:

The product and the problem or damage
The external packaging where transit damage is suspected
Any visible damage to the packaging
The shipping label

This helps us investigate and resolve the issue quickly and, where necessary, make a claim with the delivery company.

Depending on the circumstances and your statutory rights, the appropriate remedy may include repair, replacement, price reduction or refund.

Nothing in this Returns & Refunds section affects your statutory rights.

Deposits and Cancellation of Bespoke Work

A deposit may be required to confirm and schedule bespoke work.

The amount and payment schedule will normally be stated in our quotation or correspondence.

If a customer cancels a bespoke commission after work has commenced, we may retain an appropriate amount from payments already made to cover reasonable losses and costs directly arising from the cancellation, including design work, materials and manufacturing already undertaken.

Any amount retained will be reasonable in the circumstances and will not affect statutory rights.

Guarantees

Some Black Forge Art products are supplied with an additional Black Forge Art guarantee.

Any Black Forge Art guarantee is in addition to your statutory rights and does not replace or restrict them.

Where no specific Black Forge Art guarantee is advertised for a product, your normal statutory rights still apply.

Stainless Steel Collection – 15-Year Guarantee

Products specifically advertised as part of our qualifying Stainless Steel Collection are covered by our 15-year Black Forge Art guarantee from the date of purchase.

Subject to the exclusions below, this covers:

Rust or corrosion of the stainless-steel construction
Failure of welds or fabricated metal components
Failure of the metal construction to perform its intended function during normal intended use

Qualifying products are automatically covered from the date of purchase; separate registration is not required.

The 15-year guarantee applies to the qualifying stainless-steel construction and does not mean that every finish, coating, fixing, bearing, consumable or other component is guaranteed for 15 years.

Powder-Coated Finish

Where applicable to a qualifying product, our powder-coated finish is guaranteed for 3 years against premature failure arising from normal weather exposure.

This does not cover reasonable ageing, accidental damage, scratching, impact, misuse, chemical contamination, modification, neglect or damage caused by third parties.

Guarantee Exclusions

Our additional product guarantees do not cover damage resulting from:

Accident, abuse, neglect or misuse
Use for a purpose for which the product was not designed
Modification or repair by a third party without our agreement
Incorrect installation
Unsuitable, inadequate or insecure fixings or supporting structures
External forces or circumstances outside the reasonable control of Black Forge Art
Normal wear and tear where appropriate

These exclusions relate to our additional guarantee only and do not remove any statutory rights.

Installation

Unless installation by Black Forge Art has specifically been included in your order, installation is the customer’s responsibility.

Products must be installed safely and appropriately onto a structure suitable for the product’s size, weight and intended use.

Where appropriate, we recommend using a competent professional installer.

Any fixing advice or suggested fixing method provided by Black Forge Art is general guidance unless we have specifically inspected the installation location and contracted to design or undertake the installation.

We are not responsible for damage caused by incorrect installation, unsuitable supporting structures, inappropriate fixings, unauthorised modification or misuse.

Nothing in these terms excludes or limits liability where it would be unlawful for us to do so.

Product Images and Specifications

We make reasonable efforts to display and describe products accurately.

Because our work is handmade, reasonable variations may occur between individual products. Photographs are illustrative and screen settings can affect the appearance of colours and finishes.

Dimensions and weights may be approximate where stated as such.

Where a particular measurement, tolerance, colour or specification is critical to your intended use, please confirm it with us before ordering.

Ex-Display, Clearance and Used Products

From time to time we may sell ex-display, clearance, prototype or previously used products.

The condition of these products and any known significant defects will be described in the relevant listing as accurately as reasonably possible. The price may reflect their age, condition or previous use.

Any defect or characteristic specifically brought to your attention before purchase will be taken into account when assessing the condition of the product.

Your statutory rights continue to apply.

Discount Codes and Promotions

Discount codes and promotions are subject to any conditions stated with the offer.

They may be restricted to particular products, customers or periods and cannot normally be exchanged for cash.

If a discount has been applied because of an obvious technical error or in a way clearly outside the stated conditions of the promotion, we may contact you to correct the order. You will have the option to pay the correct amount or cancel the affected order for a full refund.

Intellectual Property, Designs and Customer-Supplied Material

Unless otherwise agreed in writing, copyright and other intellectual property rights in Black Forge Art website content, photographs, drawings, designs and original promotional material remain with Black Forge Art or the relevant rights holder.

Our website photographs, text and designs must not be reproduced or used commercially without permission.

Where a customer supplies a photograph, logo, artwork or other material for a bespoke commission, the customer confirms that they have the necessary permission or rights for us to use that material for the purpose of completing their commission.

Photographs of Completed Work

We may photograph work that we have designed and manufactured and may use photographs of our work for our portfolio, website, social media and promotional purposes, provided this does not conflict with an agreement made with the customer or our Privacy Policy.

If a bespoke commission is private, confidential or particularly personal and you do not want photographs of the finished work used publicly, please tell us.

We will respect reasonable requests of this nature.

Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to goods or services.

Subject to applicable law, Black Forge Art will not normally be responsible for losses that were not reasonably foreseeable when the contract was made or losses arising from circumstances outside our reasonable control.

For consumer purchases, we are not responsible for business losses arising from goods purchased wholly or mainly for personal use.

Business Customers and Commercial Projects

If you are purchasing wholly or mainly for purposes relating to your trade, business, craft or profession, you are a business customer rather than a consumer.

Additional or different terms may be agreed for commercial commissions, public artwork, architectural work, fabrication projects, trade work and other business-to-business contracts.

Where a separate written quotation, specification or contract has been agreed for a project, its specific terms will take precedence over these general terms where there is a conflict.

Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, transport disruption, supplier failure, material shortages, power failures, industrial action or other events that could not reasonably have been avoided.

Where such an event materially affects an order, we will communicate with the customer and take reasonable steps to minimise the effect.

This does not affect any rights you may have under applicable consumer law.

Visiting Our Workshop

Visitors are welcome by arrangement. As we are a working metal fabrication business located on an active farm, we strongly recommend contacting us before travelling to ensure somebody is available.

There is no permanent showroom, although examples of work currently in manufacture or awaiting collection may sometimes be available to view.

When visiting:

Please drive slowly and remain aware of farm vehicles and machinery. The site speed limit is 5 mph.
Please park without obstructing farm access.
Approach the workshop carefully and wait to be welcomed by a member of staff before entering.
Welding, grinding, fabrication machinery and other industrial processes may be operating.
Children under 18 are not permitted inside the working workshop and must be appropriately supervised elsewhere on site.
Dogs must remain outside the workshop and on a lead.
Please follow all safety instructions given by Black Forge Art or site staff.
Appropriate footwear is recommended because some surfaces are uneven.
We reserve the right to restrict access to working areas where reasonably necessary for health, safety or operational reasons.

Visitors remain responsible for taking reasonable care of themselves, children, animals and personal possessions while on site.

Nothing in these terms excludes any liability that Black Forge Art cannot lawfully exclude.

Accessibility

Our workshop is situated within an active working farm and some areas have uneven ground. Access to some working areas may therefore be limited.

If you have mobility or accessibility requirements, please contact us before visiting. We will do our best to discuss your requirements and make reasonable arrangements within the constraints of the site.

Privacy

Personal information is handled in accordance with our Privacy Policy available on our website.

Changes to These Terms

We may update these Terms & Conditions from time to time.

The terms applicable to an order will normally be those in force when the order is placed, together with any specific quotation, specification or agreement made for that order.

Governing Law

These Terms & Conditions and contracts between Black Forge Art and consumers are governed by the applicable laws of the United Kingdom.

Nothing in these terms deprives a consumer of any mandatory rights or protections available under applicable law.
